These terms

These terms are an agreement between you and Elnivo Solutions (SSM 202603291654 (003905841-X)), a sole proprietorship in Malaysia owned by Chin Chee Hoe, of Lot AL 250D, Kampung Baru Sungai Buloh, 47000 Sungai Buloh, Selangor, Malaysia ("we"), which runs Elnivo. They are also available in Bahasa Malaysia. If the versions differ, the English version applies. By using Elnivo you accept them. Our Privacy Policy explains how we handle personal data.

Who can use Elnivo

You must be at least 18 and use Elnivo for your business or work. You are responsible for what happens under your account, so keep your password safe.

Guests

You can try Elnivo as a guest without an email. Guest invoices can only be opened from the device or browser that created them, and clearing browser or app data loses access to them. A guest who doesn't create an account and hasn't used Elnivo for 30 days is permanently deleted, with their data. Create a free account to keep your records.

Free and Pro plans

  • The Free plan includes up to 5 issued invoices per calendar month, and may show a “Created with Elnivo” footer on documents.
  • Elnivo Pro adds unlimited invoices, your logo, attachments, payment links and QR codes, and removal of that footer. Pro needs an account.
  • In the iOS app, Pro is an auto-renewing subscription, monthly or yearly, bought through Apple. The price and period are shown before you buy, and payment is charged to your Apple ID.
  • A subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel it in your Apple ID's subscription settings. Cancelling stops the next renewal; Pro stays until the end of the period you paid for. Refunds are handled by Apple.
  • Pro that we granted by hand as early access, with no payment, lasts until the date we tell those accounts. We won't charge you unless you agree to a price first.
  • Rights you have under consumer law aren't affected.
  • When Pro ends, your existing documents stay available, and the Free plan's limits apply to new ones.

Your content

Your records stay yours. You allow us to store and process them only as needed to run Elnivo. You confirm you have the right to use what you enter, including your customers' personal data.

Our rights and your feedback

The Elnivo service, name, logo and software belong to us. We give you a personal, non-exclusive, non-transferable right to use Elnivo under these terms. If you send us feedback or suggestions, we may use them freely, without any obligation to you.

Invoices, tax and your records

  • You are responsible for your documents: their accuracy, tax treatment, numbering and legal requirements. Check them before you issue them.
  • Elnivo isn't accounting, tax or legal advice. It doesn't submit documents to tax authorities or to e-invoicing systems such as MyInvois.
  • Issued invoices can be voided but not deleted, to protect your records.
  • You are responsible for keeping records for as long as the law requires. Export them before you delete your account.

Acceptable use

Don't use Elnivo to:

  • create false or fraudulent documents, or break the law;
  • upload malware or content you have no right to use;
  • get around limits or security, access other people's data, or overload the service.

The service

We work to keep Elnivo available and your data safe, but we can't promise it will be uninterrupted or error-free. Keep your own copies of important records. We may change features, and will give reasonable notice of major changes where we can.

Ending your use

You can delete your account at any time from Account → Delete Account. Deletion happens after 30 days, and you can cancel until then. We may suspend or close accounts that break these terms or put the service at risk. Where reasonable, we will warn you first and give you time to export your data.

Liability

As far as the law allows, we aren't liable for indirect or consequential loss, such as lost profit or lost data. Our total liability is limited to the greater of what you paid us in the previous 12 months and USD 100. Nothing here limits rights or liability that the law doesn't allow us to limit.

Apple App Store

This section applies if you get Elnivo from the Apple App Store. If it conflicts with the rest of these terms, this section applies.

  • These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
  • Your right to use the app is limited to Apple-branded devices you own or control, as the App Store's Usage Rules allow.
  • Apple has no obligation to provide maintenance or support for the app.
  • Apple has no warranty obligation for the app beyond any that the law requires and can't be excluded. If the app fails to meet a warranty that applies, you may notify Apple, and Apple will refund any price you paid for the app. As far as the law allows, Apple has no other warranty obligation, and any other claims, losses or costs from such a failure are our responsibility, to the extent these terms and the law make us responsible.
  • We, not Apple, are responsible for handling claims about the app or your use of it, including product liability claims, claims that the app breaks a legal or regulatory requirement, and consumer protection or privacy claims.
  • If someone claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
  • You confirm that you aren't located in a country that is under a US government embargo or that the US government has designated as supporting terrorism, and that you aren't on any US government list of prohibited or restricted parties.
  • You must also follow any third-party terms that apply when you use the app.
  • If you buy Pro through the App Store, billing, renewal, cancellation and refunds are handled by Apple under your Apple ID and Apple's terms.
  • Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you, and is treated as having accepted that right.

Changes and governing law

We will post changes here and tell account holders about important ones before they take effect. Malaysian law governs these terms, and Malaysian courts have jurisdiction.
